Biography:

Matthew W. Lizotte is a civil litigator skilled in navigating individual and business clients through complex matters. He is adept at diving into intricate trial court litigation and mastering the resulting complex appellate issues. Working on behalf of landlords and tenants, he successfully brought dozens of evictions to a successful resolution during the COVID-19 pandemic and assisted clients with complicated and ever-changing requirements.

While attending Fordham University School of Law, Matthew completed an Externship with the New York City Council Legal Counsel Division which advises the mayor, other elected officials, and City agencies on issues concerning virtually every area of municipal law. Prior to joining Feerick Nugent MacCartney PLLC, Matthew has devoted his career to defending creditor’s rights in state and federal court.

Pro Bono Activities:

Matthew is a volunteer attorney for Catholic Charities where his work has been highlighted for his ability to handle complex matters for the organization. He volunteers for La Asociación para el Desarrollo de Carrizal an organization (APRODECA), which dedicated to improving the lives of the community of Carrizal, Dominican Republic with public works projects such as bringing fresh drinking water to the community and providing educational materials for children.

In the Matter of Teamsters Local 445 v. Town of Monroe; Mo. No. 2022-407

Representing the Town of Monroe, Matthew and Partner Brian Nugent successfully litigated a motion for leave to the Court of Appeals establishing that the issues facing the Town were of public importance and required a decision of New York’s highest court.

Rose Memorial Library Association; et al. v. Megan Carey; et al.; Index No. 033589/2022: Representing the Town of Stony Point, among others, Matthew and Partner Brian Nugent successfully defended the Town and the actions of the Town Clerk regarding complex election law issues.

Congregation Rabbinical College of Tartikov, Inc., et al., v. Village of Pomona; et al.; 21-2822: Representing the Village of Pomona, Matthew contributed to the successful defense of an appeal which sought to overturn a decision dismissing an action which sought to invalidate the Town’s laws.

Highview Properties, D.H.F., Inc. v. Town of Monroe, et al.; 2nd Dept. Dckt. No. 2021-04347: Representing the Town of Monroe, Matthew and Partner Donald J. Feerick, Jr. reached a resolution satisfactory to all parties resolving complex land use issues in the Westchester Environmental Part and on appeal.

Woodlands at Tuxedo Homeowners Association, Inc. v. Linda Akerman; et al.; Index No. EF005915-2021: Representing a homeowners’ association, Matthew and Partner Donald J. Feerick, Jr. reached a resolution satisfactory to all parties resolving complex homeowner’s association litigation.

Geraldine F. Baldwin v. Village of Terrytown Planning Board; et al.; Index No. 63868/2020: Representing an individual property owner, Matthew and Partner David J. MacCartney contributed to the defense of an Article 78 action resulting in the Town’s decision on the Property Owner’s application being upheld.
